Confirmation of bookings

To confirm your booking a non-refundable deposit of 25% of the total booking fee is required. If you book within 30 days of your event, the full booking fee is required at the time of booking. Please note that a signed copy of of these Terms and Conditions (Agreement) is required at time of booking.

Payment terms

We are flexible with our payment terms to help suit your schedule and needs. We will not be responsible for any fees or charges incurred by your bank or payment provider. Once you have paid the deposit and locked in the date, we will work with you to create a personalised payment schedule. All payments must be made 30 days prior to the event. If you fail to pay the deposit or balance of the booking by the due date, we may cancel your booking and retain the deposit as a cancellation fee. We will notify you by email if we intend to cancel your booking for non-payment.

Pricing

Current pricing applies to all events taking place prior to 31.12.2028, however prices are subject to increase and change without notice. All prices are inclusive of GST. The booking fee includes use of the venue for three days and three nights accommodation for up to 6 people in the farmhouse. The booking fee does not include optional extras which must be booked and paid for separately. A surcharge of 10% applies to the booking fee for all bookings that include a public holiday.

Vendors

You may hire external vendors such as caterers, photographers, or entertainers, to provide services for your event, subject to our written approval. You must provide us with the details of the vendors, including their names, contact details, insurance, and licenses, at least 30 days before your event date. You are responsible for ensuring that the vendors comply with these terms and conditions, and any other rules or regulations applicable to the property or the local area. You are also responsible for paying the vendors directly, and for any damages, losses, or liabilities caused by or affected to the vendors during your event. We are not responsible for the quality, safety, or suitability of the vendors or their services.

Cancellations

Cancellations must be made in writing to Brookhampton Road Farm (BRF). All deposits are non-refundable and non-transferable. If unforeseen circumstances occur, a change of date or postponement of an event may be possible at the discretion of BRF. In these cases, all requests by the client must be made within twenty-eight (28) days of the confirmation and the deposit will be transferred to your new date. Please note that a change of date or postponement will only be available once.

In case of cancellations, the following cancellation fees apply, depending on the notice period given:

  • More than 30 days before your event date: you will forfeit the deposit as a cancellation fee.

  • Less than 30 days but more than 14 days before your event date: you will forfeit 50% of the booking fee as a cancellation fee.

  • Less than 14 days before your event date: you will forfeit 100% of the booking fee as a cancellation fee.

Noise Policy

We reserve the right to monitor and control the noise level of all sources of entertainment within the venue, ensuring the requirements of the Environmental Protection (Noise) Regulations Act 1997 (WA) are met at all times. All amplified noise must cease by 12.00am . If you breach these conditions you may be liable for a fine of $750 and the cost of damage or compensation caused by your noise. We may also terminate all sound equipment, your booking, or ask you to leave the property immediately, without any refund or compensation.

Fire Pit

You may use the fire pit at the property, subject to the following conditions: you must check the fire danger rating and fire ban status for the area before lighting a fire, and comply with any restrictions or regulations imposed by the relevant authorities, such as the Department of Fire and Emergency Services (DFES). Candles are permitted at the property but are required to be encased so as to prohibit open flames. For the health and safety of you and your guests, sparklers and/or fireworks are strictly prohibited.

Damages

Nothing is to be nailed, screwed, stapled or adhered (including Blu-Tak) to any wall, door or surface of the building. Any damage to the property, farmhouse, equipment, fittings or surrounds caused by guests will be the financial responsibility of the organiser. You must report any damages, breakages, or malfunctions to us as soon as possible, and pay for the cost of repair or replacement. BRF is always extremely careful when looking after people and their belongings, however accepts no responsibility for the damage or loss of merchandise on our premises prior to, during or after an event. Any items left on site will be disposed of after seven days unless prior arrangement has been made.

Farmhouse

The farmhouse located on BRF is reserved exclusively for the six guests designated to stay there at the time of booking. No other guests, visitors, or staff are allowed to enter or use the farmhouse or its facilities at any time, unless written authorisation is given by BRF. The farmhouse will be locked during the event and only the six nominated guests will be allowed access. The guests are responsible for keeping the farmhouse secure and tidy, and for reporting any damages or issues as soon as possible. Any breach of these conditions will result of a fine of $300 per person for each unauthorised person found in the farmhouse. We reserve the right to evict any unauthorised persons from the farmhouse, and the property, and to cancel or terminate the event. We also reserve the right to inspect the farmhouse at any time before, during or after the event to ensure compliance with these conditions and to asses any damages or cleaning costs.

Public liability

You acknowledge and agree that your use of BRF is at your own risk, and that we are not liable for any injury, illness, death, loss, damage, or liability suffered or incurred by you or your guests, except to the extent it is caused by our negligence or breach of this Agreement. You agree to indemnify us from and against any claims, demands, actions, costs or expenses arising from or relating to you and your guest's use of the property, except to the extent caused by our negligence or breach of this Agreement. You acknowledge that the property is located in a rural area, and that there may be hazards or risks associated with the natural environment, farm animals, weather, or activities. You agree to exercise caution and care, and to follow any instructions or warnings given to you by us or the signs posted on the property. You agree to supervise any children and pets at all times, and to ensure that they do not enter any dangerous or restricted areas. You acknowledge that we have public liability insurance that covers our legal liability for any injury, illness, death, loss, damage, or liability caused by our negligence or breach of this Agreement, up to the amount of $10,000,000. You agree that this limit is reasonable and adequate, and that you will not make any claims or demands that exceed this amount. You agree that our public liability insurance does not cover your personal liability for any injury, illness, death, loss, damage, or liability caused by your negligence or breach of these terms and conditions, or by your guests, your pets, or your vendors.

Parking/Driving on the Property

Any vehicles brought to the property must be parked in the designated areas and must not obstruct or damage the access roads, driveways, or paddocks. You must comply with any signage, directions, or instructions from the venue regarding parking. BRF provides 40 car bays for the exclusive use of your guests and staff. No other parking is permitted on the farm premises, unless authorised by BRF in writing. If you, any guest, or vendor drives or parks their vehicle in a prohibited area, you will be liable for any damage caused to the farm property, environment, or infrastructure, as well as any costs incurred by the venue to repair, restore, or replace the damage.

Pets

We understand that your furry friend(s) are part of your family and you may wish to include them in your special day. We welcome pets at our venue, however we have the responsibility to ensure the safety and comfort of all guests, staff, and livestock on the property. Therefore, the following conditions apply to any pet you wish to bring to the property: you must inform us in advance that you intend to bring your pet(s), and provide us with the name, breed, size and temperament of your pet. We reserve the right to refuse any pet that we deem to be unsuitable for the venue, or may pose a risk to the property, livestock, or guests. You must pay a pet bond of $250, which is refundable after the event, provided that there is no damage or extra cleaning required as a result of your pet. You are liable for any costs that exceed the pet bond, and we may invoice you accordingly. You must supervise your pet at all times, and ensure your pet is well-behaved, under your control and on a leash when walking around the property. You must not leave your pet at the property unattended, or disturb any wildlife or livestock on the farm. You must also ensure that your pet does not bark excessively, bite, scratch, or injure anyone or anything on the property. You must provide your own food, water, bedding, and any other items your pets may require. We reserve the right to ask you to remove your pet from our property at any time and terminate your booking without refund, if your pet violates any of these terms, or we deem your pet to be a nuisance, danger, or a breach of our Agreement. By bringing your pet to our venue, you agree to abide by this pet policy, and to indemnify and hold us harmless from any claims, liabilities, losses, or damages that may arise from your pet's presence or actions on the property. You also acknowledge that you are solely responsible for your pet's welfare, safety, and behaviour, and that we are not liable for any harm, injury, or loss that may befall your pet on the property.

Drugs

BRF is committed to providing a safe, legal and enjoyable environment for all guests. As such, we do not tolerate the possession, use, supply or distribution of any illicit drugs on the premises or in its vicinity. Any guest or contractor who is found to be in breach of this condition may face the following consequences; immediate removal from the premises, without refund or compensation, reporting to the police and possible prosecution under the Misuse of Drugs Act 1981 (WA) or any other relevant legislation, which may result in fines, imprisonment or both. Liability for any damage, injury, loss or expense caused by or arising from the breach of this condition, includes but not limited to the cost of cleaning, repairing or replacing any property, equipment or facilities of the venue or any other third party, forfeiture of the security bond, deposit or any other payment made to BRF or other third party in relation to the booking and/or exclusion from any future bookings or events at BRF.

Alcohol

You may bring and consume your own alcohol at BRF, subject to the following conditions: you must be over 18 years of age, you must consume alcohol responsibly and not cause a nuisance, disturbance, or harm to yourself or others, you must not supply alcohol to anyone under 18 years of age, or to anyone who is intoxicated or disorderly, you must not drive or operate any vehicles or machinery while under the influence of alcohol, you must comply with any applicable laws and regulations regarding the consumption of alcohol, such as the Liquor Control Act 1988 (WA), you must not sell or supply alcohol to anyone for a fee or reward, unless you have obtained a liquor license from the relevant authorities. If you breach any of these conditions, you may be liable for a fine of $500 and the cost of any damage or compensation caused by your alcohol consumption. We reserve the right to terminate your booking and ask you to leave the property immediately, without any refund or compensation.

Smoking/Vaping

Smoking and vaping is strictly prohibited inside the farmhouse and any other indoor facilities. You may smoke or vape outside, but you must dispose of your cigarette buds or vaping pods in the designated areas provided. Smoking/vaping is prohibited entirely during restricted burning periods. The restricted burning period is subject to seasonal conditions and these dates are advertised by local government. If you breach this condition, you may be liable for a fine of $500 and the cost of any damage or cleaning that is required.

Camping

Camping is welcome at the property should you wish your guests to stay the night with you at BRF. We recommend hiring glamping tents from external vendors. You/your guests/external vendors are responsible for setting up, maintaining, and removing the tents and any associated equipment and facilities, and for complying with all relevant health, safety, and environmental regulations and standards. External vendors must supply BRF with copies of their insurances, licenses, and permits, along with a detailed plan of the layout and location of the glamping tents and any other structures or amenities, at least 30 days prior to the event. Please note that we reserve the right to modify or deny all glamping requests. You are responsible for the hire and provision of adequate toilets depending on the number of guests staying at the property, in accordance with the guidelines and requirements of the local council and the property, as determined at the time of booking. BRF is not liable for any loss, damage, injury, or claim arising from or relating to the use of our campground or any other facilities provided by BRF or external vendors, and you/external vendors must indemnify BRF from any such liability.

Clean up

You are responsible for leaving the venue and its surroundings in a clean and tidy condition, as you found it, at the end of your event. This includes removing all rubbish, decorations, personal belongings, vendor equipment, and furniture from the venue and disposing of them appropriately. We reserve the right to charge a clean up fee of $750 (or a fee of $75 per hour) if the venue and its surroundings were not left in a satisfactory condition, as determined by BRF. The clean up fee may be deducted from the security bond or invoiced to you after the event, at the BRF's discretion.

Deliveries

Items being delivered on your behalf must be boxed and labeled with event name clearly marked. All items must be delivered no earlier than 3.00pm the day before the event and collected by 10.00am the day following the event. Other drop off times must be arranged with BRF. Should pack down of outsourced or

personally supplied items be required by BRF, an additional minimum fee of $350.00 will be applicable. Although all care is taken, no responsibility is taken for lost or damaged goods.

Miscellaneous

All bookings will require a security deposit of $2000 to be paid 30 days prior to the event. This will be returned to you promptly after the event/stay has concluded.

To protect our grounds, we only allow natural confetti such as lavender and flower petals. Please contact us if you wish to use confetti, as it is not permitted in some areas of the farm.

You must stay within the designated areas of the property as shown on the map provided to you at the time of booking, and follow all property signage. You and your guests are not permitted to access any other areas of the property including, but not limited to, sheds, dams, paddocks or fences without a BRF staff member.

You must not touch, feed, chase, harass, or disturb any livestock on the property, including but not limited to the sheep, cows, alpacas, ducks or wildlife unless accompanied and supervised by a BRF staff member. You and your guests must respect the animals' welfare and safety and follow the instructions of BRF at all times.

The property is limited to a total number of 150 guests, six guests in the farmhouse and 30 campers. Any breach of this condition may result in termination, without refund or compensation.
